Welcome to Make It Urs. These Terms and Conditions (“Terms”) govern your access to and use of our Design Partner Service (“Service”). Please read these Terms carefully. By subscribing to the Service, you agree to be bound by these Terms.

1. The Service

Make It Urs provides a subscription-based design and branding partnership. Your subscription includes:

• A Dedicated Creative Queue: You can add design projects to your personal queue at any time.
• One Active Project: We will work on one project from your queue at a time.
• Proactive Curation: Based on our initial strategy consultation, we will proactively suggest design projects for your queue to ensure a continuous, strategic workflow. You may approve these suggestions or add your own projects.
• Delivery: We will deliver the first draft of most design requests within an average of 48 business hours. Complex projects, such as brand guidelines or multi-page brochures, will require a longer timeline, which will be communicated upfront.
• Scope of Services: The Service includes a comprehensive list of design capabilities, including but not limited to brand identity, marketing materials, and digital graphics. The Service does not include 3D modeling, motion graphics/video editing, website/app development (coding), or on-site visits/photoshoots.

2. Subscription & Billing

• The Plan: The Service is offered as a single plan at a flat rate of $2,495 per month (“Subscription Fee”).
• Billing Cycle: The service is a recurring subscription. Your payment method will be charged automatically on the same day each month. All payments are securely processed through our third-party payment processor, Stripe.
• Pausing Your Subscription: If you do not have immediate design needs, you may pause your subscription. Our billing cycles are based on a 31-day period. For example, if you use the Service for 15 days and then pause, your subscription will be inactive, and you will have 16 days of service remaining to use at any time in the future.
• Cancellation: You may cancel your subscription at any time. The cancellation will take effect at the end of the current billing cycle, and you will not be charged again.

3. Refund Policy

We offer a limited refund option to ensure our partnership begins with confidence. You are eligible to request a refund of fifty percent (50%) of your initial subscription fee within the first fifteen (15) calendar days of your subscription start date, no questions asked.

To initiate a refund request, you must contact us in writing at wegotu@makeiturs.co within this 15-day period. No refunds of any amount will be granted for requests received after the initial 15-day period has passed. This policy applies only to your first month of service; all subsequent monthly renewal payments are non-refundable.

4. Intellectual Property Rights

• Your Ownership: When a design is finalized and approved, and upon full payment for the relevant billing cycle, you (the “Client”) will own the finalized design and its source file.
• Our Rights: Make It Urs, LLC retains full ownership of all preliminary concepts, drafts, and other working materials. Make It Urs, LLC also retains the right to showcase the finalized project in our portfolio and marketing materials unless otherwise noted and agreed upon in writing.

5. Client Responsibilities

To ensure a productive and efficient partnership, you agree to:

• Provide clear, detailed, and timely information in your design briefs.
• Deliver feedback on designs in a timely manner.
• Communicate respectfully and professionally with our team.

Delays in providing feedback or necessary information may impact project delivery timelines.

6. Confidentiality

Make It Urs, LLC agrees to treat all information you share with us as confidential. We will not disclose any of your proprietary or confidential information to any third party without your prior written consent. Likewise, you agree not to share any proprietary information about our creative process or business practices.

7. Limitation of Liability

To the maximum extent permitted by law, Make It Urs, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your access to or use of our Service.

8. Term and Termination

This agreement begins upon your subscription to the Service and will continue on a month-to-month basis until terminated. You may terminate the agreement at any time by canceling your subscription. Make It Urs, LLC reserves the right to terminate the partnership at any time for any reason, including violation of these Terms, with notice provided to you.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
